Sometimes you write about subjects you did not want to
address. This is one such article. I would much rather discuss a bright future
than rehash unpleasantness from the past. Sometimes the air must be cleared and
the record set straight.
Yesterday, Al Gerhart was charged with two felonies –
blackmail and violating the Oklahoma Computer Crimes Act. This is a man who has
attempted to claim leadership at times in the past of both the Liberty Movement
and the Tea Party movement in Oklahoma (two different but philosophically
similar groups). To my knowledge, neither group wants him anywhere near them.
Let me give you a few examples of why.
The Liberty Movement / 2012 Ron Paul for President
Campaign
Last year beginning in March the “grassroots” leadership of
the Ron Paul for President Campaign attempted to have Gerhart fired as the
State Coordinator of the official campaign. There are numerous articles in
The McCarville
Report, an Oklahoma political blog, detailing such efforts. On April 13
th,
2012 a letter was sent to the Ron Paul for President national campaign by 27
leaders of the grassroots effort, after other attempts to address things had
failed. He was finally removed prior to the State Convention. I was one of
these leaders – and this is one reason I have been targeted by Gerhart (and
many others of these 27 have also been targeted). Have you ever heard of
volunteers demanding the person running a campaign be fired for incompetence?
Now you have. Here is a paragraph from the letter:
This letter is an
official request by the Grassroots Leadership of the Liberty Movement and Ron
Paul effort in Oklahoma for the Ron Paul National Campaign to immediately
terminate Al Gerhart from the position of State Coordinator for Ron Paul.
The text is in red in
the original, which is why it is in red here. I added the italics. You could
say that the Liberty Movement has disavowed Al Gerhart, or at least most of the
leadership within Oklahoma has. I do not know of anyone of prominence who has
followed his lead after this letter was sent.
The Tea Party
I am not officially a member of any “Tea Party”. These
groups are usually informal gatherings of like minded citizens who are Taxed
Enough Already. By this definition, I could be a member of most of them. When
the Tea Party movement really got going, I was working more than 80 hours a
week, with a full time and a part time job. Add on to that three kids, and I
just didn’t have time to get active – which I regret. The only event I attended
was a January event at the Coca Cola Center in Bricktown, and I don’t even remember
what year it was. In Oklahoma City there is one large group – the
OKC Tea Party. They specifically disavowed Gerhart, as well.

Whatever has happened or happens in the
future, please be advised that Mr. Gerhart does not speak for the Tea Party
movement in the State of Oklahoma. He merely speaks for himself and an
independent organization or group (if you can call it that) he founded in 2009
called the Sooner Tea Party, based in Moore, OK where his business is based.
While we at the OKC Tea Party do not endorse the tactics Mr. Gerhart seems to
routinely use (i.e. verbal personal attacks and threats to public figures to
either do things his way or the highway, electively speaking), we believe we
can safely say that the many other independent Tea Party groups within our
State adopt the same stance as we do — focusing on issues rather than the
diminution of specific personalities.
So, there is the “real” Tea Party (2,456 members on
Facebook) distancing itself from Gerhart (Sooner Tea Party, 14 likes on
Facebook), along with the Liberty Movement.
Blackmail and Libel
I personally don’t think the actions of Mr. Gerhart regarding
Senator Branan – as ham-fisted and offensive as they were – rise to the level
of blackmail (nor violating the Computer Crimes Act). His actions resulted in
the perfect excuse to kill a bill that should have been heard. In my opinion,
the District Attorney should not have filed charges, and I believe Gerhart will
win his case. Then again, I’m not a lawyer, so maybe there is something I am
missing here. I DO believe everyone has a right to criticize public officials
and investigate their background. They just don’t have a right to lie about it
or attack their families with lies…which brings me to his actions against me.
On a personal level, both I and my wife were attacked by Mr.
Gerhart and/or the Sooner Tea Party. My personal, political, financial,
criminal, and employment histories were misrepresented with wild allegations.
As an example, a divorce case with minor children from February of 2002 was
cited. The person in the case has the same name as my wife – except, it is not
my wife. She has only been married one time – to me. There are several people
who have both her married and maiden name – and several people in the area also
have my name. This is just one example of the many allegations either directly
said about us or implied about us that are false. Here is the legal definition
of libel:
Libel
is a false or malicious unprivileged publication by writing, printing, picture,
or effigy or other fixed representation to the eye, which exposes any person to
public hatred, contempt, ridicule, or obloquy, or which tends to deprive him of
public confidence, or to injure him in his occupation, or any malicious
publication as aforesaid, designed to blacken or vilify the memory of one who
is dead, and tending to scandalize his surviving relatives or friends. Oklahoma
Statute §21‑771
It should be noted that libel does not apply to truthful
statements. When they are clearly lies, and clearly done with malicious intent,
it rises to the level of a crime in addition to the potential civil penalties.
The crime of libel is a misdemeanor punishable by not more than 1 year in the
county jail and a $1000 fine. I have consulted with several attorneys who all
believe I have a winnable civil libel case – and I am considering filing one. I
have not contacted the District Attorney to file charges, and have no plans to
do so – but I seriously considered it. The door is still open on filing a civil
case, but I would have to get in line. You see, there is another matter on Mr.
Gerhart’s legal docket…
Whetsel, Sorrels, and Jarjoura
How do you screw up a sensational story? You make things up
and add them to the facts of the case. A good story sticks to the facts. For
example, there is a dentist from Edmond who is a Reserve Deputy Sheriff. There
are legitimate questions about his donations to the Oklahoma County Sheriff’s
office, how he became a Reserve Deputy Sheriff, and the lawsuits he is involved
in (for example,

is denial of a motion to dismiss from February 17
th, 2012). I
never published this story because I had not fully researched it before it
became public knowledge. The problem arises when Gerhart questioned the
national
origin and religion of this person – which was completely unnecessary. As a
consequence, the story shifted from being about questioning the judgment of the
sitting Sheriff in the selection of his reserve Deputy Sheriff to
the libel lawsuit brought
against not only Gerhart but the Republican candidate for Sheriff Darrell
Sorrels, his campaign manager Steve Long, and a volunteer Carol Knight. To
quote from the
Oklahoman:
The
article questions whether Jarjoura has terrorist ties and whether Whetsel overlooked
the dentist’s criminal background when selecting him as a reserve deputy.
Gerhart
said what prompted his concerns was discovering that Jarjoura had contributed
thousands of dollars in cash and vehicles to the department and to Whetsel’s
re-election campaign about the same time he began training as a reserve deputy.
Public records show Jarjoura contributed money and vehicles during that time.
If Mr. Jarjoura wins his case, I doubt there will be much
left to sue Mr. Gerhart for, beyond the satisfaction of winning my case. There
is also the additional expense he is about to incur in his criminal defense.
The damage is now done, however, to my reputation. Some day my four children
will search my name on the internet, and find lies. That can never be recalled.
What he has done to me – and numerous other people, including many of my
personal and political friends, is an evil thing. I am now faced with the
decision of just how much more time and money I wish to devote to this matter.
Both would be better spent with my wife and children.
But for those who are
self-seeking and who reject the truth and follow evil, there will be wrath and
anger – Romans 2:8

Gerhart to change his ways, and begin by seeking not just truth, but the whole
truth. If you are a candidate with ties to Mr. Gerhart, don’t ask me or my
friends for help. If you are a source of “information” or funding to Mr.
Gerhart, beware. It is probable that during all of these legal actions his
sources of funding and information will become public as a result of the
discovery process.
With all of the above in mind, ponder this: I think the
District Attorney should not have filed charges against Mr. Gerhart. This
is a chilling attack on free speech by the state. That is the real
story, destined to be lost in the drama that surrounds this situation. Losing
the real story and the real fight due to incompetence and/or idiocy is The
Gerhart Problem. Mr. Gerhart is, as usual, irrelevant.
